Topic ex-spouse tricked me

This is a mess........... I divorced my husband of 25 yrs. I had supported him and his drinking and drug habit all that time. I left and was given custody of my daughter. He now lives on soc sec because he has organic brain disease. He pays me no support........but I do recieve $$ off his ss. I went back to school and have been financially strapped, so he gave me permission to use a small visa card of his to get some things for my daughter for christmas. Now he calls me and tells me that he canceled the card and told the visa he wants me prosecuted. So I sent out a money order today for all that was owed.I know it was stupid for me to trust him after knowing he was so abusive all those years, but I just didn`t think he would set me up like this.The visa people called me today and ask me if I was using his card unauthorized and I would only say that I needed to talk with my ex first. I didn`t admit to anything.Am I in Big trouble????
he did give me permission by phone, but I have no proof of that. My name is not on the card, but the internet orders I placed were to be shipped to my home address, even the bill in his name each month was shipped to me and I paid each month and then paid it all off to visa by money order yesterday. The visa company did call yesterday and ask for me by name and threatened to file felony prosecution charges against me. That`s how I found out that he reported the card lost or stolen. I only used the card a couple of times for gas money to get my daughter to therapy and to charge online for school clothes and christmas presents. It was only a $400.00 card to begin with. I just don`t want to be in any legal trouble now.

Hmm, this is a bit messy.
You state that you placed some orders online using the card, so I must assume that you had the card in your possession since you would have been required to provide an expiration date when placing the orders, something that can only be found on the card itself. Therefore, either your Ex gave you the card or you stole it. So, it's your word against your Ex.
I would strongly advise you to do the following:
- Respond to the credit card company verbally when they ask and tell them the truth, that you were authorized to use the card. Your Ex gave you permission by phone to repeatedly use the card.
- Respond to the credit card company IN WRITING. Ask them for the proper address. Send the letter certified.
- Tell them all the details of your story. Don't worry about who they will believe... tell your side. They have a lot of experience with these types of cases and they can figure it all out.
- It sounds like you were making the payments on the card. If you were committing fraud, why would you do that? Point this out to the credit card company.
- Provide copies of any and all documentation you can get your hands on: copy of the money order stubs, receipts showing the clothing purchases, any documentation you have that you paid the bills, etc.
-The most important thing you can do is stand up for yourself. Now is the time to tell the whole story.
